Аннотация:Abstract:In the preparation of the Nuremberg trials, the world community first encountered the problem of bringing
to justice those responsible for mass violations of human rights, but not violating national laws. When, after the
Second World War, attempts were made to determine the rules for punishing those who committed crimes during
the Third Reich, they were guided by the well-known formula of the German philosopher of law Gustav Radbruch.
The article analyzes this formula, examines the practice of its application in the process of the Nuremberg Tribunal,
and the practice of German courts after the unification of East and West Germany.
